These Terms and Conditions (“Agreement”) govern your use of the consultation services provided by Boat Coach LLC (“Boat Coach,” “we,” “us,” or “our”), a company that specializes in providing expert consultation and instruction for boat owners. By engaging with Boat Coach and utilizing our services, you (“Customer,” “you,” or “your”) agree to comply with and be bound by these terms.
1. Agreement to Terms
By engaging Boat Coach for any consultation services (the “Services”), you agree to the terms set forth in this Agreement. If you do not agree to these terms, you must refrain from using the Services. This Agreement constitutes a binding contract between you and Boat Coach.
2. Scope of Services
Boat Coach provides remote consultation and expert guidance to boat owners on various technical aspects of boat maintenance, repair, and modification. The Services include, but are not limited to, video phone consultations covering the following areas:
* Boat Carpentry
* Marine Fiberglass Repair
* Rigging
* Inboard and Outboard Mechanics
* Marine Electrical Systems
* Canvas and Sailmaking
* Marine Cooling (AC and Refrigeration)
* Boat Design and Major Systems (e.g., mast location, rudder design)
* Detailing
These Services are delivered exclusively via video phone technology (e.g., video calls, remote assistance) and do not involve any on-site or physical interaction with the Customer’s boat.
3. Disclaimer of Warranty
Boat Coach offers consultation services based on the information you provide. While our team of experts strives to provide accurate, relevant, and effective advice, we make no warranties, express or implied, regarding the accuracy, completeness, or suitability of the advice provided. The information shared during consultations should not be construed as professional or legal advice and is provided on an “as-is” basis.
4. Limitation of Liability
To the fullest extent permitted by law, Boat Coach shall not be liable for any damages, including but not limited to direct, indirect, incidental, consequential, special, or punitive damages, arising from the use of or reliance on our Services. This limitation of liability applies to any claims, whether in contract, tort, negligence, strict liability, or any other legal theory, and applies even if we have been advised of the possibility of such damages.
5. Customer Responsibilities
As a Customer, you agree to:
* Ensure the accuracy of the information: You are responsible for providing accurate, complete, and up-to-date information about your boat.
* Obtain necessary permits: It is your responsibility to secure any permits or approvals required by law before performing any work on your boat.
* Follow safety practices: You are solely responsible for ensuring the safety of the boat, yourself, and anyone else involved in the work on your boat.
* Implement advice safely: You assume all responsibility for performing work on your boat based on the advice provided, and for the quality and safety of such work.
6. Independent Contractors
All technicians and consultants providing Services are independent contractors, not employees of Boat Coach. Boat Coach does not control the methods or processes used by these independent contractors, and we are not responsible for any actions, omissions, or failures on their part.
7. Indemnification
You agree to indemnify, defend, and hold harmless Boat Coach, its affiliates, employees, officers, directors, independent contractors, and agents from and against any and all claims, losses, damages, liabilities, expenses (including attorney’s fees), arising from:
* Your use of the Services.
* Any work or repairs conducted on your boat, whether based on advice from Boat Coach or not.
* Any claims by third parties arising from your actions or omissions in connection with …
